Clerk

Edenville Township is a General Law township, governed by Michigan Compiled Law which can be found at legislature.mi.gov.

Each office of your General Law township board has statutory duties. The word “duty” is not used lightly. MCL 750.478 provides that any public officer who willfully neglects to perform a statutory duty, “where no special provision shall have been made for the punishment of such delinquency,” is guilty of a misdemeanor punishable by imprisonment for not more than one year or a fine of not more than $1,000.

All four of your township board members have a duty to serve as township legislators, setting policy and direction for the township. All members are required to ensure that government functions are funded and provided and act in compliance with the Open Meetings Act and Freedom of Information Act. All board members are required to participate in deciding and budgeting for optional government functions, use of property, compliance with laws, setting policy, hiring and creating policy. They are responsible for the townships fiduciary health through avoiding risk and waste. All board members determine staffing needs and comply with employment law. All board members are required to attend meetings and vote on all issues.

The township clerk plays a critical role in the operation and administration of township government. Michigan law requires the township clerk to carry out three major responsibilities involving township recordkeeping, financial operations and elections. Many of the clerk’s duties are carefully detailed by state law and do not permit much personal discretion. Of course, the clerk is also a member of the township board with a vote equal to the other members, voting on questions of budget, personnel appointments, zoning and all other matters that come before the township board.
